Legal Battle Unfolds as Illinois Deadline for Assault Weapons Registration Stands

In a significant development on the Illinois assault weapons ban, U.S. District Judge Stephen McGlynn issued a crucial 34-page order declining an injunction to postpone the Jan. 1 registration requirement. This order came after gun rights advocates had requested an emergency injunction to halt the registration of guns and accessories covered under the Protect Illinois Communities Act, arguing that the requirements were unconstitutional. Additionally, lawyers for Federal Firearms Licensees of Illinois, gun rights advocates, gun dealers, and individual gun owners voiced concerns about the vagueness of the rules governing the registration of already-owned assault weapons and insufficient notice from the state.

Notably, Judge McGlynn emphasized the expeditious need for a full review of the legal challenges to the Protect Illinois Communities Act, indicating a shift towards an exhaustive review of the Act and the Emergency Rules on the merits. The Illinois attorney general’s office supported this stance by asking the court to dismiss the due process claims. The judge also hinted at the forthcoming discernment of Illinois FOID cardholders’ compliance with the registration scheme, highlighting the relevance of their adherence to certain claims on the merits.
