California’s Landmark Lawsuit Settlement: $2 Billion Pledged for Student Recovery from Pandemic Learning Losses

In Los Angeles, parents like Kelly R are relieved after a successful lawsuit against California, demanding more support for underserved students, particularly those hit hard by pandemic learning losses. The lawsuit, filed by parents, students, and community groups, targeted the state’s failure to adequately address the educational setbacks faced by predominantly low-income Black and Latino kids during the Covid pandemic.

Pandemic Learning Losses Addressed: California Commits $2 Billion Settlement to Aid Students’ Recovery

Kelly R, one of the plaintiffs, humorously mentioned not expecting a “fat check” but expressed hope that her children and others would benefit from addressing pandemic learning losses. Virtual schooling was a struggle for many parents, including Kelly, who found herself unprepared to be a teacher for her three daughters during the pandemic. Glitchy computers, internet issues, and a lack of training added to the challenges.

To settle the lawsuit, California agreed to allocate $2 billion to assist the most affected children in recovering from pandemic learning losses and mental health impacts caused by school closures during the pandemic. Despite the federal government granting over $190 billion for such purposes between March 2020 and March 2021, the plaintiffs argued that California failed to ensure the targeted use of funds for students needing the most help in overcoming pandemic learning losses.

The settlement, yet to be enacted into law, directs school districts to employ extended school days, tutors, and mental health professionals to aid these students in recovering from pandemic learning losses. The state will closely monitor this process, allowing parents to file complaints if needed.

Pandemic Learning Losses Exposed: Lawsuit Sparks Urgent Measures for Educational Equity and Recovery

The lawsuit highlighted significant issues during the pandemic, such as lack of digital access, broken equipment, and untrained teachers in handling remote learning, contributing to pandemic learning losses. Around 10,000 public schools in California were closed, affecting approximately 6 million students, with up to a million kids having no digital access for 18 to 19 months, amplifying pandemic learning losses.

While some students are recovering well, others, especially in higher poverty districts, are still struggling with pandemic learning losses. The fear among researchers is that some students might never fully catch up. Kelly, for instance, acknowledges her kids are behind in math, emphasizing the importance of addressing historic inequities in education and combating pandemic learning losses.

The lawsuit and settlement are seen as crucial steps toward acknowledging and rectifying educational disparities, providing hope for a more equitable future free from the lingering effects of pandemic learning losses.
