San Francisco residents have sued the city over the Guaranteed Income for Trans People (GIFT) Program.

Legal Battle Over San Francisco’s Guaranteed Income for Trans Program

Plaintiffs claim Democratic Mayor London Breed‘s November 2022 initiative is “illegal” preferential treatment. Guaranteed Income for Trans People (GIFT) provides $1,200 monthly for up to 18 months to “low-income transgender San Franciscans,” helping them with financial issues.

The lawsuit claims the scheme favors biological men who identify as females, violating Article 1, Section 7 of the California Constitution. Mayor Breed, City and County Treasurer José Cisneros, Office of Transgender Initiatives Executive Director John Doe, and City Administrator Carmen Chu are defendants.

Guaranteed Income for Trans People (GIFT) provides cash support and “gender-affirming medical and mental health care,” to 55 applicants from January 2023 to 2024. The program’s website says undocumented people who meet certain requirements can apply.

Controversy Erupts Over San Francisco’s Guaranteed Income for Trans People Program

Mayor Breed justified the initiative, citing trans populations’ poverty and marginalization. The lawsuit claims the program discriminates against transgender minorities based on race and sexuality. The plaintiffs want a court injunction to stop the city from using taxpayer cash for Guaranteed Income for Trans People (GIFT).

Judicial Watch President Tom Fitton accused San Francisco’s “transgender extremists” of violating the state’s constitution by allocating taxpayer money by race and sex. The legal challenge on Guaranteed Income for Trans People (GIFT) casts doubt on targeted financial support programs’ constitutionality and stimulates disputes over preferential treatment and equal protection.
