Baldwin’s charges were dropped in April 2023 after he pled not guilty in February. After new prosecutors took over, the criminal case resumed. A grand jury reassembled and considered two charges: careless firearm usage, a non-crime, or unintentional homicide without reasonable caution or prudence, a fourth-degree felony.

Baldwin waived his right to an arraignment and risks a fresh legal struggle with a maximum 18-month jail sentence. The return of charges complicates an already complicated situation.

Baldwin pleads not guilty to involuntary manslaughter and evidence tampering. The October 21, 2021, on-set tragedy killed Halyna Hutchins and injured director Joel Souza when Baldwin’s pretend gun hit him during a Rust scene rehearsal. Gutierrez-Reed denies wrongdoing.
