Lawsuit Targets Biden’s Student Loan Policy: Legal Battle Over the SAVE Repayment Plan

According to Bloomberg Law, in a recent federal court decision three Republican-led statesSouth Carolina, Texas, and Alaska—have made progress in their challenge against a Biden administration rule aimed at reducing monthly student loan payments and expediting loan forgiveness. Judge Daniel D. Crabtree of the US District Court for the District of Kansas acknowledged that while these states just barely proved their legal standing others in the coalition of 11 GOP-led states did not meet the threshold. States like Kansas, Alabama, and Louisiana were dismissed from the lawsuit due to insufficient legal standing.

The lawsuit centers on a July 2023 Department of Education rule called the SAVE repayment plan. This rule allows borrowers to enroll in income-driven repayment plans and potentially have their loans forgiven after a certain period of repayment. Kansas Attorney General Kris Kobach leading the legal effort argued that the rule harms state organizations that hold student loans by reducing revenue which impacts tax income and the states’ ability to attract and retain employees. While the judge upheld the standing of the three states based on potential revenue reductions for their public instrumentalities the ruling highlights the legal complexities surrounding challenges to Biden’s student loan policies.
