DECD and Auditors Fight Interpretation: Legislative Compliance in Tax Credit Issuance

Bipartisan state auditors recently uncovered a controversial matter with the Connecticut Department of Economic and Community Development (DECD) and the awarding of $50 million in tax credits to a digital animation company in an audit report covering three fiscal years. Although state legislation forbids digital animation companies from gaining such benefits, the auditors claim that the DECD gave the company access to film production tax credits. On the other hand, the DECD challenges this interpretation, claiming that their reading of the law permits businesses to submit separate applications for credits under several statutes. A well-renowned animation studio best known for movies like “Robots” and “Ice Age,” Blue Sky Studios, Inc., received the tax credits in issue, based on a Smart News article. However, the firm closed its doors in 2021 due to the COVID-19 epidemic.
