According to The Sun, Shoppers and former clients of Paycom should act quickly to take advantage of a data breach settlement that doesn’t require proof of loss to qualify. The settlement stems from a lawsuit against the payroll and human resources technology provider, which alleged that the company failed to adequately protect personal information during a data breach in 2023.
Background on the Breach
According to the lawsuit, a hacker accessed sensitive client information via MOVEit Transfer, a secure file transfer application, compromising personal data. The plaintiffs claimed that Paycom did not implement sufficient cybersecurity measures to prevent the breach. While Paycom has not admitted to any wrongdoing, the company has agreed to a settlement of $900,000 to resolve the claims and avoid further legal expenses.
Eligibility for Claims
To qualify for a portion of the settlement, affected individuals must meet certain criteria:
- Residency: Claimants must reside in the United States.
- Breach Notification: Individuals must have had their personal information accessed during the breach, which occurred between July and October 2023. Paycom should have notified those affected about the compromised information and sent a postcard regarding the settlement, which includes a Claim Login ID and Claim Login PIN.

How to File a Claim

The deadline for filing a claim is set for November 7, 2024. This date also marks the deadline for any exclusions or objections to the settlement. A final hearing for settlement approval is scheduled for December 13, 2024. Missing the claim deadline could result in individuals forgoing thousands of dollars.

Potential Payments
The distribution amount for each claimant will vary based on several factors. Individuals with documented out-of-pocket losses due to the breach can claim up to $2,500. This can include compensation for up to four hours of lost time dealing with identity fraud issues, such as credit monitoring or freezing credit reports, calculated at a rate of $25 per hour, allowing for a maximum of $100 per person.
For those who experience losses stemming from identity theft linked to the breach, they can claim $4,200, which also includes three years of credit monitoring services.
Other Data Breach Settlements
In addition to the Paycom settlement, there are other data breach settlements that consumers should be aware of. Select hotel guests may be eligible for up to $4,000 if they file an online form soon. Additionally, Cash App users could potentially receive checks worth $2,500 as part of a $15 million data breach settlement.
Individuals impacted by these breaches are encouraged to file their claims as soon as possible to ensure they don’t miss out on any available compensation.
