Details of the Lawsuit
The plaintiffs in the suit claimed that P.C. Richard & Son printed the expiration dates of customers’ debit and credit cards on their receipts, which they argue violates the Fair and Accurate Credit Transactions Act (FACTA). While the company denies any wrongdoing and does not admit to violating FACTA, it has agreed to a $4.9 million settlement to resolve the claims and avoid further legal expenses. Eligible customers can receive payouts from this settlement, provided they meet specific criteria.
Eligibility Requirements for Settlement Payments
To qualify for compensation from the P.C. Richard & Son receipt settlement, customers must meet the following requirements:
- Payment Method: Customers must have used an American Express credit or debit card for their purchases at P.C. Richard & Son stores.
- Transaction Dates: The transaction must have occurred between November 12, 2015, and August 18, 2016.
- Receipt Information: Customers must have received a printed or electronic receipt that includes the expiration date of their American Express debit or credit card.
Customers who meet these criteria should have received a written notice by mail containing their claim number. The notices will feature either the letter “A” or the letter “P.”

Claim Filing Process
For those who received the “A” class identifier, no further action is required; they will automatically receive a payment from the settlement. However, individuals with a “P” designation must file a short-form claim online through the settlement website. To initiate this process, customers need to enter the numbers following the letter “P” and include their last name.
The deadline to file a claim is November 26, 2024. Note that the deadlines for objections and exclusion requests have already passed as of July 22 and July 29, 2024, respectively. A final approval hearing took place on August 20, 2024, and payments are expected shortly after the claim deadline.
Payment Details
Distributions from the settlement will be made on a pro-rata basis, depending on the total number of eligible claims submitted. Each eligible individual can receive a maximum of $1,000, contingent on providing proof of receipt from P.C. Richard & Son.
It is important for recipients to note that the settlement checks will include an expiration date of 180 days from the date of issuance, so it is essential to cash them promptly.
