Based on the court documents, a 20-year-old male was detained and charged with sexual battery of a 14-year-old girl after he messaged her on Instagram.
Charged With Sexual Battery
In a report from East Bay Times, through a criminal complaint submitted in late July, Moises Lopez, of Oakland, was charged with sexual battery by restraint and contacting a juvenile to conduct a sex offense, both felonies. Records reveal that he entered a not guilty plea during a recent court appearance.
Authorities were informed by the alleged victim that Lopez had contacted her over Instagram. After their conversation, he told her “he could not wait to kiss (the girl) and to conduct oral copulation on her,” and told her not to tell anybody about their encounters, according to a court document filed by an Oakland police detective. Police claim that when the girl arrived at Lopez’s house, he forcibly grabbed her buttocks, causing her to flee and call the police.
After Lopez’s counsel submitted a motion defining the alleged crime as a “consensual texting exchange” and noting that they had previously planned to meet at a laundry, Lopez was freed from custody.

Released from Custody Without Bond
In a successful plea for Lopez’s release from custody without bond, the defense attorney, Deputy Public Defender Jennie Otis, claimed that when he recommends they smoke together, she responds excitedly and even begs him to “hurry up” while waiting for him at the laundromat, reports The Mercury News.
When Lopez was taken into custody, according to the police, he allegedly stated that someone else had hacked onto his Instagram account to impersonate him but declined to give further details. According to reports, the kid recognized Lopez as the person who touched her improperly in a photo lineup.
