BECKLEY, W.VA.- On Wednesday, January 8, 2025, Devin L. Cresce, 28, of Beckley, West Virginia, appeared in the U.S. District Court for the Southern District of West Virginia and pleaded guilty before U.S. Magistrate Judge Omar J. Aboulhosn to Distribution of 50 Grams or More of a Substance Containing Methamphetamine.
Following entering his guilty plea on Wednesday, Judge Aboulhosn accepted the plea and scheduled sentencing for May 9, 2025, at which time Cresce faces a mandatory minimum of five years and up to 40 years in federal prison, at least four years of supervised release, and a $5 million fine. The actual term of imprisonment will be determined by a U.S. District Court Judge based on the seriousness of the offense and Cresce’s prior criminal history.

According to U.S. Attorney Will Thompson and documents filed with the court, on or about July 13, 2023, Cresce sold around 53 grams of methamphetamine to a confidential informant in exchange for $500 while in a vehicle in the parking lot of the Crossroads Mall in Mount Hope, West Virginia, during a controlled buy under the observation of law enforcement agents.
During his plea allocution on Wednesday, Cresce admitted to that sale and further admitted to selling an additional 80 grams of methamphetamine for $750 on July 18, 2023, approximately 24 grams of methamphetamine for $180 on July 28, 2023, and around 62 grams of methamphetamine for $750 on August 8, 2023. Each of the sales occurred from Cresce’s home and involved the same confidential informant.
Following the controlled buys, on August 10, 2023, law enforcement agents obtained and executed a court-authorized search warrant at Cresce’s Beckley, West Virginia residence. During the search, agents located and seized 94.5 grams of fentanyl and 63 grams of methamphetamine.
Further, during Wednesday’s plea hearing, Cresce also admitted that he possessed the fentanyl and methamphetamine found in his home and intended to distribute the substances throughout the Southern District of West Virginia.
