NEWKIRK — Escudero appeared in Kay County District Court on Dec. 30, 2024 and entered a no contest plea in the case. He was sentenced to a 10-year suspended prison sentence. In a second case filed in 2023, he was convicted of assault and sentenced to a five year suspended sentence ordered to complete 80 hours of community service and pay $941.09 in restitution.

Court date set for suspect accused of assaulting a store cashier

NEWKIRK — A status docket is scheduled in Kay County District Court for Max Escudero, 25, Ponca City, who is facing first degree robbery and conspiracy charges.

Ponca City police report that on July 30, 2024, officers responded to the Stop N Go, 501 west Highland, for a report of an assault.

Upon arrival police found an ambulance crew treating a female cashier who was suffering from a laceration on upper lip.

The cashier reportedly told police that two Native American males were buying beer. She said one used a phone to pay but that only a $1.70 was approved and that the total was $17.07. The male reportedly claimed that his card was charged $40.

A verbal altercation ensued during which the male reportedly spit on the female’s face. As the male, later identified as Escudero, was walking out the door, the cashier reportedly threw a bottle of Gatorade at him. He reportedly went back in the store, threw the cashier on the floor and punched her in the head and face.

She told police that as he was assaulting her, the other subject ran to the back and grabbed four cans of Bud Light Tajin beer and left.

The assault suspect left his tribal ID card behind, which police used to identify him as Escudero.

Police reviewed video and corroborated the clerk’s story. Police searched the surrounding area but did not locate the suspects. A warrant with bond endorsed at $35,000 was issued on Sept. 12. Escudero was arrested and jailed on Sept. 17. He remains in the county jail.
