Couple Denied Of Lower Bond After Baby’s Death In Arkansas

Vincent and Emily Heyns were denied of a lower bond after being accused of causing their baby’s death in Arkansas. However, the cause of death was undetermined despite discovering marijuana in the couple’s house.

On November 1, 2022 at around 2 p.m., the Benton County Sheriff’s Office reportedly received a call about an unresponsive baby at 12671 Scenic Drive in Rogers, Arkansas. The baby’s mother, Emily Heyns, then 21, stated that she was with her husband, Vincent Heyns, then 24, and grandfather Robert Rose. It was at that time when they realized that the baby, 2-month-old Waylon, was not breathing anymore.

According to Williams, Rose said he went to sleep, while the couple was still awake. The couple reportedly slept at around 8-9 a.m. At around 2 p.m., Rose woke up and knocked on the bedroom. Vincent was reportedly sleeping with Waylon lying on his chest. When Vincent woke up, he stated that Waylon descended from his chest. They checked on him and he seemed fine. However, a few minutes after Rose left the bedroom, Emily came screaming for him saying that Waylon was not breathing anymore. Rose then told Vincent to call 911 while he performed CPR. An affidavit stated that Vincent thinks he has squished Waylon while sleeping.

During the Trial

According to Neal, Vincent and Emily Heyns were arrested in connection with the death of Waylon. Both have faced charges of endangering the welfare of a minor and manslaughter. The couple previously pled innocent to the charges. However, they are now being held in the Benton County jail for a $100,000 bond. The attorneys for the couple requested for their bonds to be lowered. However, Judge Robin Green of Benton County Circuit denied the requests. She scheduled a jury trial for the couple to start on March 28.

Ray Spruell, Emily’s attorney, also asked the judge to release his client from custody. Spruell stated that the autopsy results revealed that the cause of Waylon’s death was undetermined. There were no traces of drugs in the baby’s system. Therefore, there is no indication that Emily was negligent of Waylon’s welfare. However, deputy prosecutor Wilson Raines argued that the undetermined cause of death should not affect Emily’s bond. 

Not An Isolated Case

Green also argued that the couple was under the influence while sleeping with Waylon. The authorities discovered marijuana paraphernalia in the couple’s house which made them admit that they had been smoking the substance. In addition, this incident is not an isolated case as the couple had another baby die under the same circumstances in 2021.

Neal stated that a year prior to the recent incident, the authorities received a call from the same address on July 13, 2021. A 4-month-old baby has reportedly died. Investigations revealed that the couple was both sleeping with the baby. The baby was also in Vincent’s arms when he died. Spruell, however, insisted that there was no negligence against the couple in that incident. The first child reportedly died of sudden infant death syndrome.
