Earl Moore, 35, died, and Peggy Finley and Peter Cadigan are accused of his homicide. They are being detained in the Sangamon County Jail after entering a not guilty plea on Friday. Finley, 44, and Cadigan, 50, each face a sentence of 20 to 60 years in jail if found guilty. Officers can be seen attempting to get Moore to his feet in a police body camera footage.
According to Finley, he later told hospital officials and an investigator that Moore had been aggressive. During Friday’s hearing, Attorney Dan Wright stated that an autopsy revealed that Moore died of positional asphyxiation and had two broken ribs. The court hearing was filled with objections, the majority of which came from defense counsel, who claimed Wright was fabricating testimony by grilling the lone witness. A defendant is charged with first-degree murder in Illinois when they are aware that their actions have a high likelihood of resulting in their death or significant bodily damage. According to Judge Jennifer Finley and Sgt. Zachary Weisahaar, they saw Moore flailing who also observed a policeman move out of the path.
A recording of Finley’s call to notify the hospital of their arrival was played for the court by Wright. Moore’s blood alcohol content was.076, which is barely below the.08 Illinois driving limit. Finley walked into the apartment and shouted at Moore to stand up. Finley and Cadigan, according to Weisahaar, have the necessary education and experience to understand the dangers of Moore’s viewpoint.
According to their lawyers, they want to request their release on personal recognizance. The Moore family has sued the ambulance company and its employer for wrongful death (Connor and Foody, 2023).
