Hotel guests can claim up to $4,000 from data breach settlement and you only to fill out quick online form


According to The Sun, Certain guests of the Fontainebleau Florida Hotel LLC could be in line for substantial one-time payments following a class action lawsuit stemming from a data breach that exposed sensitive personal information. The luxury hotel group, which operates upscale hotels in Las Vegas and Miami, has reached a settlement agreement to address the claims without admitting any wrongdoing.

Details of the Data Breach Lawsuit

The lawsuit alleges that a data breach in 2022 compromised customers’ personal information, including Social Security numbers and financial details. The plaintiffs argue that Fontainebleau failed to implement adequate cybersecurity measures to prevent unauthorized access to their systems.

While Fontainebleau has not admitted guilt, the company opted for a settlement to resolve the legal claims and avoid incurring further litigation costs. The settlement is pending court approval, with a claim filing deadline of October 31, 2024, leaving affected guests only hours to submit claims for compensation.

Eligibility Criteria for Settlement Distribution

To qualify for a distribution from the settlement, individuals must have been directly impacted by the 2022 data breach. Those eligible would have received a notice via email or mail regarding the incident, which reportedly occurred between August 30 and September 2, 2022.

Claimants are required to provide documentation that verifies any out-of-pocket expenses incurred due to the breach. Acceptable forms of documentation include bills, bank statements, credit reports, invoices, receipts, and tax documents.

How to File a Claim

Eligible guests should have received a postcard containing a Claimant Login to facilitate the claims process. If you did not receive this postcard, it is recommended to contact the class administrator at 866-742-4955 for assistance.

Claims can be filed through the official settlement website using the provided Claimant Login, or applicants can download a PDF form and mail it to the class administrator. Remember, the deadline to file a claim is October 31, 2024.

Payment Distribution and Benefits

The amount of potential compensation will vary based on the documented out-of-pocket expenses submitted by claimants. Each claimant can receive up to $1,000 to reimburse losses such as bank fees, credit costs, communication charges, and travel expenses. Additionally, lost time due to the breach will be compensated at a rate of $25 per hour, up to four hours.

For those who experienced fraud or identity theft resulting from the data breach, a significantly larger payment of up to $4,000 may be awarded. In addition to financial compensation, all eligible claimants will receive two years of credit monitoring and identity theft protection services.

Fontainebleau has also committed to enhancing its cybersecurity measures to prevent future incidents.

Next Steps and Approval Hearing

The final approval hearing for the settlement is scheduled for December 9, 2024, after which eligible claimants can expect to receive their payments in the following weeks.
