‘Deepfake’ AI Nude Image Creation Led To Arrest And Expulsion Of Middle School Students In Florida

According to WIRED acquired police report, two Florida middle school boys, aged 13 and 14, allegedly used an “artificial intelligence” application to generate nude images of their classmates. They shared the images without consent.

According to WIRED, the police were informed of the incident on December 6, 2023 and the arrest happened on December 22. It was reported that the two boys aged 13 and 14 years old, used an “artificial intelligence application” to generate the fake explicit images of their classmates who were between 12 and 13 years old. The report also claimed that the boys shared the AI nude images between each other.

When the school administrator knew of the images, he interviewed the victims in the images. It was found out that they did not consent to the images created. One of the victim’s mother said that her daughter does not feel comfortable walking the same hallways with those boys. A victim was also reported saying that it makes her feel violated and taken advantage of and felt used.

According to The Verge, on Friday the school, local district has voted to expel the five students involved in the case.

Florida’s first arrest and criminal charges related to AI-generated nude

With the arrest of the two middle school students, The Verge reported that it may have been the first instance of criminal charges in relation to generated AI nude images. The two boys were charged with third degree felony under a 2022 Florida law. It’s a law that criminalizes the distribution of altered images that are explicitly sexual without consent.

There is no existing federal law addressing nonconsensual fake nudes and this is an issue that states need to resolve as generative AI can be used on child sexual abuse material or revenge porn. President Joe Biden has issued an executive order on AI which should ban the use of AI on these issues.
