An Albuquerque man has been sentenced to 18 months of probation after pleading guilty to involuntary manslaughter for the shooting death of a home intruder in October.
Elias Garcia, 67, was at his home near Broadway and Sunport Boulevard when a woman reportedly cut through a screen door and entered. Garcia told police that he confronted the woman and held her at gunpoint, warning her he would shoot if she moved.
As Garcia attempted to call 911, a struggle ensued when the woman attempted to leave the residence, resulting in the gun firing and the woman’s death.
At his sentencing on Tuesday, Garcia expressed remorse and apologized to the victim’s family.
