Dr. Caitlin Bernard, 37, an obstetrician-gynecologist, revealed that she had provided abortion services to a 10-year-old girl. Reportedly, the child had traveled from Ohio for the procedure in June 2022. This is because after the Roe ruling, the state of Ohio generally prohibited abortions when cardiac activity was detected around 6 weeks into a pregnancy.

According to an article in CNN, the state of Indiana passed a law that prohibited abortions except for rape, incest, saving a woman’s life, and lethal fetal abnormalities. At first, several Republicans were skeptical of the Indiana doctor’s claims about the child being a rape victim. However, a man was eventually charged with raping the child and a detective from Ohio had testified about the abortion.

Actions Against Indiana Doctor

According to El-Bawab, in November, Attorney General Todd Rokita filed a complaint against the Indiana doctor. Eventually, on May 25, the Indiana Medical Licensing Board found that Bernard was liable on three counts of violating patient privacy laws. In addition, the Board had also fined Bernard after determining that her revelation violated federal and state patient privacy laws.

Nonetheless, the Board dismissed the two other accusations mentioned in the complaint. This was after they determined that the Indiana doctor did not violate the laws that required physicians to keep up-to-date of mandatory reporting and patient privacy laws and immediately report suspected child abuse. However, Bernard will be fined with $3,000 and will receive a letter of reprimand.
